A Florida court recently issued an injunction against Keyflow’s former U.S. distributor as well as its owners and related companies. Recently, Keyflow’s former distributor abruptly switched to selling horse feed products under the brand “Key Performance” or “Key Performance Feeds.”
After an evidentiary hearing in early March, the court found that the use of the names “Key Performance” and “Key Performance Feeds” in connection with horse feed products was likely to cause consumer confusion with the registered KEYFLOW® trademark.
As a result, the court ordered that Keyflow’s former U.S. distributor, as well as its related companies and officers, employees, agents, distributors, retailers, and others who have notice of the order and are involved in advertising, promoting, distributing, or selling products under those names, must immediately cease advertising, promoting, distributing, or selling equine nutrition products under the names “Key Performance,” “Key Performance Feeds,” or other confusingly similar marks.
The injunction also requires the immediate cessation of related promotional activity, including physical advertising, product packaging, delivery vehicles, social media marketing, domain names, and other digital promotion using those marks.
This order also applies to third-parties with notice of the order who may also be using or promoting the “Key Performance” or “Key Performance Feeds” brand.
The order, and the on-going litigation, does not affect the continued sale of genuine KEYFLOW® equine nutrition products distributed through the official Keyflow distribution channel operated by Keyflow Feeds Inc. (Delaware), a company within the same group as the manufacturer and trademark owner, Keyflow (UK) Ltd.
Authentic KEYFLOW® horse feed products remain available through this official distribution channel.
